I would not say the best answer, but I appreciate the response.
I found the solution. hope it helps others in the future:
I copied the purecloud user role, and started checking around with a test user account I have available, it took hours to check many permissions available.
i found the following Quality > Evaluation > Participate with the conditions stated above (user = current user / evaluation state = finished, in review, retracted / evaluation is released = true), they blocked both agent and admin: agent can't participate, and admin can't create these evaluation for the agent.
conditions were just simplified to user = current user, no additional conditions required, as the evaluation is just being created, it wont fulfill the conditions state or if released or not.

"X user does not have evaluation participate permissions", but in fact the role assigned does have the following permissions:
Analytics > interactionEvaluationDetails > View
Quality > Evaluation > Add
Quality > Evaluation > Dispute
Quality > Evaluation > Edit
Quality > Evaluation > Edit Agent Sign-off
Quality > Evaluation > Participate
Quality > Evaluation > View
(These whole set in highlight, with the conditions: user = current user / evaluation state = finished, in review, retracted / evaluation is released = true)

what am I missing here? Please advise, already went through support without much luck.
